Republic Act 9136 provides implementation of retail competition and open access on distribution wires. Initially, the Energy Regulatory Commission shall allow all electricity end-users with a monthly average peak demand of at least one megawatt (1MW) for the preceeding twelve (12) months to be the contestable market. Two (2) years thereafter, the threshold level for the contestable market shall be reduced to seven hundred fifty kilowatts (750kw). Subsequently and every year thereafter, the ERC shall evaluate the performance of the market.
FLECO in its present condition does not serve any customer with a monthly average peak demand of 1MW. Its customers are mainly residential with some commercial but very few low load industrial consumers. Hence, its consumers are not yet qualified to join the market on open access. It may take a little more time for big load industrial consumers to settle at the FLECO franchise area meantime that development is just starting at the area. However, FLECO anticipates that industry will be at its height in Pagsanjan considering that tourism is its prime business.
